Please read these Terms of Use ("Terms") carefully before using the WakeUp 2day application ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using WakeUp 2day, you agree to these Terms of Use and our Privacy Policy. If you do not agree to these Terms, do not download or use the App.

2. License

WakeUp 2day grants you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple device that you own or control, subject to the Apple Media Services Terms and Conditions. This license does not allow you to use the App on any device you do not own or control, and you may not distribute or make the App available over a network where it could be used by multiple devices at the same time.

WakeUp 2day is not a medical device. Sleep tracking data, sleep scores, sleep phase information, and heart rate displays are provided for informational and entertainment purposes only. They should not be used for medical diagnosis, treatment decisions, or as a substitute for professional medical advice. If you have concerns about your sleep or health, consult a qualified healthcare provider.

The Persistent Wakeup feature is designed to help you wake up but is not guaranteed to work in all circumstances. Do not rely solely on the App for critical wake-up situations (e.g., catching a flight, medical appointments). Always have a backup alarm method for critical events.

6. Smart Home Disclaimer

Smart home automation features interact with third-party devices and services including Philips Hue, Home Assistant, Apple HomeKit, Nuki smart locks, and LG ThinQ climate devices. Some integrations communicate locally on your network (Philips Hue, Home Assistant, Apple HomeKit), while others use cloud APIs (Nuki via api.nuki.io, LG ThinQ). We are not responsible for:

WakeUp 2day does not collect, store, or share any of your smart home data, credentials, or device information with third parties. All smart home credentials (API tokens, access keys, bridge addresses) are stored exclusively on your device. We do not operate any servers and have no access to your smart home data. When using cloud-based integrations (Nuki, LG ThinQ), data is transmitted directly between your device and the respective service provider — we are not an intermediary in this communication.

7. Intellectual Property

All content, design, graphics, sounds, animations, themes, and code in WakeUp 2day are the intellectual property of the developer and are protected by copyright and intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App, nor may you reverse-engineer or attempt to extract the source code.

8. Data & Privacy

Your use of the App is also governed by our Privacy Policy. The App stores data locally on your device and optionally in your personal iCloud account. We do not collect, transmit, or have access to your personal data.

9. iCloud Backup

The optional iCloud backup feature uses your personal iCloud storage. You are responsible for managing your iCloud storage capacity. We are not responsible for data loss due to iCloud service issues, storage limits, or Apple account problems.

10. Availability & Updates

We reserve the right to modify, update, or discontinue the App at any time without prior notice. We may release updates that change features, fix bugs, or add new functionality. Continued use of the App after updates constitutes acceptance of any changes.

11. Limitation of Liability

To the fullest extent permitted by applicable law, WakeUp 2day and its developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

You agree to indemnify and hold harmless the developer from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

The App integrates with Apple services (WeatherKit, HealthKit, iCloud, HomeKit) and optional third-party smart home platforms (Philips Hue, Home Assistant, Nuki, LG ThinQ). Your use of these services is subject to their respective terms and conditions. We are not responsible for the availability, accuracy, or reliability of third-party services. All credentials for third-party services are stored locally on your device only.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.

15. Apple's Standard EULA

This App is licensed to you under the Apple Licensed Application End User License Agreement (EULA), available at Apple's website, in addition to these Terms. In the event of a conflict between these Terms and Apple's Standard EULA, Apple's EULA shall prevail.

16. Changes to Terms

We reserve the right to update these Terms at any time. Changes will be reflected on this page with an updated "Last updated" date. Continued use of the App after changes constitutes acceptance of the revised Terms.
